NOTICE TO OUR CLIENTS ABOUT CHANGES TO WORKERS’ COMPENSATION MEDICAL PAY

Under recent revisions to the Delaware Workers’ Compensation Law, insurance companies may dispute the treatment you are receiving by requesting that an independent doctor conduct a Utilization Review. A Utilization Review is not the same as a defense medical examination which is an examination of you conducted in person by a local doctor. In a Utilization Review, your medical records are sent to an out-of-state doctor for review and an opinion as to whether the treatment you are receiving complies with certain Practice Guidelines applicable to workers’ compensation cases.

Under the new Utilization Review law, we are not sent a copy of the report prepared by the reviewing doctor. However, the law requires that the doctor send you a copy of the Utilization Review report by mail. It is vital that you notify us as soon as you receive this report. There is only a limited period of time in which to file an appeal of the Utilization Review report, if necessary, so it is imperative that you notify us of your receipt of the report as soon as you receive it (the same day, if possible).
