THIRD PARTY CLAIMS

Q:  I was hurt in a car accident while I was on the job and the accident was not my fault.  What rights do I have?

A: You can make a claim for compensation under BOTH automobile insurance and worker’s compensation insurance. (See our links for workers' compensation and automobile insurance). Your attorney will seek to coordinate these benefits to secure the maximum recovery for you.

Q; What sort of recoveries can I make?

A: Under Delaware law, we’ll often seek to secure payment of your bills and 2/3 of your wages (up to the State maximum) under Workers Compensation. We’ll attempt to make up some of the 1/3 wage loss through the insurance on the vehicle you are in ( called PIP ).
Delaware law does not permit you to sue your employer for your injuries, even if your employer was at fault or negligent.  However, you do have the right to bring a claim against a third party (someone who is not your boss or co-employee) for your pain and suffering.  However, the Worker’s Compensation insurance company will likely seek to be reimbursed for some of the money they paid in your claim.

Q:  Do I need a personal injury attorney to handle these kinds of claims?

A: You should hire a law firm that is well experienced in these matters.  Insurance laws are often quite complicated and are often changing; so choose a law firm that can competently handle your claim.  Our firm has handled matters like this for over 30 thirty years.
