Standard Questions at Section 341 Hearing (First Meeting of Creditors)

Your 341 Hearing is most likely the only hearing that you will have to attend for your bankruptcy. These hearings are public and it is advisable to arrive 10 to 15 minutes prior to your scheduled hearing time to listen to the hearings to see how the process works. Depending on your situation, the Trustee may ask additional questions.

•  Name, address, and telephone #
•  Did you review your petition before you signed it?
•  Did you read the bankruptcy information sheet?
•  Have you filed bankruptcy before?
•  Did you list all of your assets? All of your debts?
•  How long have you lived in Delaware ?
•  Have you paid any of your creditors more than $600.00 in the 90 days prior to the filing of the case?
•  Have you used any of your credit cards recently?
•  Are you currently employed?
•  Are you currently involved in a divorce?
•  Have you sold or transferred any property in the past 2 years? In the past 4 years?
•  Are you party to a personal injury lawsuit or any other type of lawsuit which could result you receiving money damages?
•  Do you expect to inherit any money or property within the next six months?
•  How did you determine the value of your home?
•  Do you have any life insurance policies? If so, do they have any cash value?
•  With which company do you have your homeowner's insurance with? Your car insurance?
•  Do you understand the effect bankruptcy has on your obligations?
•  Is there anything that you need to change/add to your petition?
•  Have you owned a business in the past 6 years?
•  What is the reason that you filed bankruptcy?

The typical 341 hearing lasts approximately 5 to 10 minutes. The wait time until your hearing is called can vary from a few minutes to a few hours, depending on the number of hearings scheduled.
