Personal Injury Insurance Settlements

The following are some of the frequently asked questions regarding insurance settlements:

Q: Does every claim you make for the consumer have to go to trial?

A: No. In fact, the great majority of cases never do go to trial.  They are resolved through negotiation with the insurance company. 

Q:  How does your firm prepare for an insurance company settlement in my personal injury case?

A: The preparation begins the first day that you are in the office. We will thoroughly review and investigate your claim, whether for workers' compensation (learn more), job construction accidents (learn more) or automobile accident (learn more).  Each client is assigned an attorney experienced in your area of law, and a highly trained paralegal that will assist the attorney with your case. After your medical condition has stabilized and you’ve reach maximum medical improvement, we will prepare a demand letter to the insurance company which will set forth your claim with all the necessary documentation including medical bills and records. We’ll decide on a number to demand. Within a few weeks, we’ll often receive an offer for settlement from the insurance company. You’ll come in and meet with us to discuss the offer; at that point we’ll often make a counteroffer. No case is ever settled without your approval.

Q: What happens if the case is not resolved?

A: If we can’t settle your claim by negotiation, then we’ll suggest the filing of a lawsuit.  Your attorney will work closely with you to explain that process. 

Q: Are your fees less if the case resolves before a lawsuit is filed?

A: Yes. If we can save the time and expense of preparing a lawsuit, there may be a reduction in fees. Your attorney will explain the fees in more detail at the initial consultation.
