Medical Malpractice Cases
Q: What kinds of medical malpractice cases are there?
A: Whenever a healthcare provider has not followed the standard of care and a consumer has been injured, Delaware law could provide for a medical malpractice claim. These claims could be against any one or all the healthcare providers who have treated the victim. We have handled claims against health care providers and a hospital; regrettably, their negligence caused the death of a child (see the attached newspaper article).
Q: What sort of birth injury claims could be made?
A: Expecting a child is one of the happiest and most stressful times in our lives. During the birth process, the medical providers will seek to control over their role to make sure your baby is born healthy. However, there are some common mistakes made during pregnancy and birth delivery including: misdiagnosis of problems, allowing a delivery to take too long, applying to much pressure to the baby's head, neck or shoulder, failing to closely monitor the baby's health after birth. If any of the above lead to injury which could include paralysis or severe brain injury, there may be a claim.
