Additionally, you might have a claim for the failure of a party to maintain a safe jobsite. This claim could be made against the general contractor or a subcontractor. These are typically called third party claims. Delaware law does not permit you to sue your employer or a co- employee: your claim against these parties is through Workers Compensation. The benefits we collect on third party claims are on top of Workers Compensation benefits. We often have to pay some of the recovery to the Workers Compensation insurance company upon resolution of the case.
